At H. Rosen Law, P.C., we take pride at the wide range of legal areas we practice and are always striving to learn new areas of law to assist our clients. Mr. Rosen is certified as a specialist in the practice of workers’ compensation law by the Pennsylvania Bar Association’s Section on Workers’ Compensation Law as authorized by the Pennsylvania Supreme Court. Workers’ Compensation benefits are available to all employees injured during the course and scope of their employment. Such employees are entitled to medical treatment and if the injuries cause an employee to lose wages, then his or her employer is responsible to pay wage loss benefits. If an employee suffers hearing loss, loss of vision, an amputation, a loss of use of a body part, or a scar on the head, face or neck at work, Workers’ Compensation benefits are available. Benefits are also available to family members and heirs in the unfortunate case of death as a result of an incident at work. Workers’ Compensation laws differ from state to state and the benefits available differ in Pennsylvania and New Jersey. Many factors come in to play to determine each individual’s rights under the law. For more information, please contact us for a free consultation.
Social Security Disability
Social Security Disability (SSD) benefits are available to individuals who cannot maintain substantial gainful employment due to physical or mental injuries, regardless of how those injuries were sustained. In order to be eligible for benefits, the individual must have worked and paid taxes for at least 20 quarters (5 years) within the previous 10 years leading up to the date they are no longer able to work. If an individual does not meet this threshold, but cannot maintain substantial gainful employment due to physical or mental injuries, he or she still may be entitled to Supplemental Security Income (SSI), depending on their household income. Individuals injured as a result of another party’s negligent, careless, or reckless actions may be entitled to recover damages; including economic and non-economic damages, pain and suffering, wage loss, and payment/reimbursement for medical treatment. At H. Rosen Law, P.C., we work to make recoveries for people injured in motor vehicle accidents, unsafe products or property, and medical/professional negligence. Insurance/Bad Faith Claims
An insurance policy is a contract that makes certain requirements that both the policy holder and insurance company are required to follow. We represent policy holders who have complied with their obligations under the insurance policy, but the insurance company has not. When an insurance company does not comply with its obligations under a policy, and knows it has no reasonable basis for failing to do so, a bad faith insurance claim is appropriate. In this type of action, a policy holder may be entitled to actual contract damages, punitive damages, attorney’s fees and costs. For more information, please contact us for a free consultation.
The need for legal assistance arising out of an employment relationship can stem from many different areas of law, including contract law (wrongful termination), constitutional law (discrimination, due process), workers compensation, and general litigation (unemployment). Pursuant to the many statutory and common laws enacted over the years, both employers and employees are granted certain rights and obligations. These rights and obligations may vary from case to case. For more information, please contact us for a free consultation.
In addition to those enumerated above, we also handle small commercial litigation, creditor/debtor actions, landlord/tenant actions, and preparation of wills and living wills. For more information, please contact us for a free consultation.
