Damages Available

Every person who can successfully prove their personal injury case is entitled to financial compensation, which is known as “damages” under the law. In Pennsylvania, victims in personal injury cases can be compensated with two types of damages: 

  1. Economic damages refer to recoverable monetary losses and include medical bills, rehabilitation costs, loss of income, property damage, and other expenses and losses that can be objectively calculated; and 

  1. Non-economic damages refer to losses that are more subjective in nature and include mental anguish, pain and suffering, loss of enjoyment of life, emotional distress, and other immeasurable losses.  

When the plaintiff (the injured party) can prove that the defendant (the party being sued) engaged in malicious, willful, wanton, reckless, or oppressive behavior, they can be awarded the third type of damages: punitive damages. However, these damages are rarely awarded in personal injury cases in Pennsylvania.  

Personal Injury Law in Pennsylvania

Every state has personal injury laws to enable people who have been injured through the negligence of another party to seek compensation for their losses and damages and restore themselves to the pre-accident condition as much as possible. Personal injury laws differ from one state to another. Some of the laws you should be aware of when filing a personal injury claim in Pennsylvania include: 

  • Comparative negligence. Under the doctrine of “comparative negligence,” the injured victim is entitled to financial compensation even when they are partly at fault. However, when the victim’s own fault contributed to their injuries, the damages they will be permitted to collect will be reduced by the percentage of their fault. Pennsylvania is a modified comparative negligence state that follows the 51 percent rule. In other words, it means that injured parties are not permitted to recover damages if they are 51% or more at fault.  

  • Statute of limitations. This law sets the time limit on how long the injured party has to file a personal injury claim. In most cases, Pennsylvania sets a two-year statute of limitations for civil actions arising from personal injury claims, though there may be exceptions. If a civil action is filed after the statute of limitations expires, the victim will be barred from recovery.
